A local HVAC contractor and client of Robertson Insurance & Risk Management had questions about a contract he was asked to sign. Not sure what the language in the contract meant, he scheduled a meeting and contract review with our legal team at so he would better understand the risk he faced. After reviewing the contract, many suggestions were made and the contractor knew what he was getting himself into. The mark-ups suggested by us were accepted by the general contractor, and the project started.
After several months on the job, the project was winding down, but the payments to all the subcontractors working for the general contractor were drying up. They eventually stopped. The HVAC contractor was still owed over $50,000 and the general contractor refused to pay anyone. The HVAC contractor returned to his contract and warned that without payment he would file a Mechanic's Lien to protect his interests. The general contractor claimed that the contract prevented him from doing so. The HVAC contractor replied that the Mechanic's Lien section - one identified as a risk during the contract review - was struck and initialed by all parties. A check was issued to our client the next day!
